2. Applicability
These general terms and conditions apply to all quotes, orders, invoices, services and agreements between XpointCars and its customers, both private individuals and companies, unless expressly agreed otherwise in writing.
By placing an order or having a service performed, the customer agrees to these conditions.
3. Services
XpointCars carries out work within the automotive sector, including maintenance, repairs, cleaning and related services, as agreed and to the best of its ability.
All services are performed personally by or under the supervision of XpointCars.
4. Quotations and prices
All quotes are without obligation and valid for 14 days, unless stated otherwise.
Prices are expressed in euros (€) and are exclusive of VAT, unless otherwise stated.
XpointCars reserves the right to change prices in case of errors or unforeseen circumstances, provided that the customer is notified in advance.
5. Payments
Invoices are payable within 14 days of invoice date, unless otherwise agreed.
In the event of non-payment, the customer will first receive two payment reminders. If no payment is received after this, XpointCars reserves the right to pass the claim on to a third party and charge any administration and collection costs.
Any disputes regarding invoices must be reported in writing within 7 days of the invoice date.
6. Cancellation
Cancellation of an appointment or order by the customer is only possible after consultation and written confirmation by XpointCars.
If the customer does not cancel in a timely manner (at least 24 hours in advance), XpointCars may charge a reasonable fee for the reserved time or costs already incurred.
7. Liability
XpointCars carries out all services with the utmost care, but is not liable for:

  • indirect damage (such as loss of profit, loss of time, consequential damage, etc.);

  • damage caused by incorrect or incomplete information provided by the customer;

  • damage resulting from wear and tear, age or defects not caused by XpointCars.

The liability of XpointCars remains in any case limited to the invoice amount of the relevant service.
8. Complaints
Complaints about services provided must be reported in writing within 7 days of completion via info@xpointcars.com.
XpointCars will handle every complaint carefully and find an appropriate solution in consultation with the customer.
9. Force Majeure
XpointCars is not liable for delays or failure to fulfill obligations if this is due to force majeure (such as illness, accidents, technical defects, natural disasters, power failures or other unforeseen circumstances beyond its control).
10. Applicable law and competent court
Belgian law applies to all agreements.
In the event of a dispute, only the courts of the judicial district of Dendermonde will have jurisdiction, unless mandatory law provides otherwise.
11. Final provisions
If any provision of these terms and conditions is held invalid, the remaining provisions will remain in full force and effect.
XpointCars reserves the right to amend these terms and conditions at any time. The latest version is always available at www.xpointcars.com .

2. Welke persoonsgegevens verzamelen wij?
Wij verzamelen enkel de gegevens die nodig zijn voor onze dienstverlening. Dat kunnen onder meer zijn:

  • Naam en voornaam

  • Adres en contactgegevens (e-mail, telefoonnummer)

  • Bedrijfsnaam en btw-nummer (indien van toepassing)

  • Voertuiggegevens (zoals kenteken, merk, type, onderhoudshistoriek)

  • Betalings- en facturatiegegevens

  • Communicatiegeschiedenis (e-mails, berichten, afspraken)

3. Waarom verwerken wij deze gegevens?
Wij verwerken jouw persoonsgegevens uitsluitend voor de volgende doeleinden:

  • Het opstellen en uitvoeren van offertes, afspraken en facturen

  • Het uitvoeren van onderhouds- en hersteldiensten

  • Communicatie met klanten (bijv. planning, opvolging, vragen)

  • Wettelijke boekhoudkundige verplichtingen

  • Verbetering van onze dienstverlening

Wij gebruiken jouw gegevens niet voor geautomatiseerde besluitvorming of profilering.
4. Hoe verzamelen wij jouw gegevens?
Wij verzamelen gegevens:

  • Rechtstreeks van jou (via e-mail, telefoon, formulier op de website of bij een bezoek)

  • Automatisch via onze website (enkel technische cookies, indien van toepassing)

5. Delen wij gegevens met derden?
Wij delen jouw persoonsgegevens enkel met derden als dat noodzakelijk is:

  • Voor administratieve en boekhoudkundige verwerking (bv. boekhouder)

  • Voor technische ondersteuning van onze website of IT-systemen

  • Wanneer wij daartoe wettelijk verplicht zijn

In elk geval zorgen wij ervoor dat deze partijen jouw gegevens vertrouwelijk behandelen en niet gebruiken voor eigen doeleinden.
6. Bewaartermijn
Wij bewaren persoonsgegevens niet langer dan nodig is:

  • Klantgegevens: maximaal 7 jaar (conform fiscale verplichtingen)

  • Communicatie (e-mails, berichten): maximaal 2 jaar na het laatste contact

  • Gegevens verzameld via websitecookies: volgens de instellingen van je browser

7. Beveiliging
XpointCars neemt passende technische en organisatorische maatregelen om jouw persoonsgegevens te beschermen tegen verlies, misbruik of ongeoorloofde toegang.
Voorbeelden hiervan zijn: beveiligde verbindingen (HTTPS), sterke wachtwoorden en beperkte toegang tot klantgegevens.
8. Jouw rechten
Je hebt te allen tijde recht op:

  • Inzage in de persoonsgegevens die wij van jou bewaren

  • Correctie van onjuiste of onvolledige gegevens

  • Verwijdering van gegevens (“recht om vergeten te worden”)

  • Beperking of bezwaar tegen verwerking

  • Overdraagbaarheid van jouw gegevens (kopie opvragen)

9. Cookies
Onze website kan gebruik maken van functionele cookies om de werking te verbeteren.
Wij gebruiken geen tracking- of marketingcookies zonder jouw toestemming.

10. Klachten
Ben je van mening dat jouw gegevens niet correct worden behandeld?
